These Terms of Service (“Terms”) are an agreement between you and Top Games Inc. (“Top Games,” “we,” “us,” or “our”) governing your use of the Real Games Now mobile application for Android and iOS and its related websites and services (together, the “App”). By installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian, who is responsible for your use, including any purchases.
2. The App
Real Games Now lets you discover and play instant games on your device. Games may be developed by Top Games or by third parties. Game availability, features, and content may change, be added, or be removed at any time. We do not guarantee that any particular game will remain available.
3. Accounts
You may play as a guest. Guest progress is tied to your device and may be lost if you uninstall the App or change devices. You may optionally sign in with Google, Apple (iOS), or your phone number to keep progress across devices. You are responsible for keeping your sign-in credentials secure and for all activity under your account. You may delete your account at any time as described in the Privacy Policy.
4. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial entertainment. All rights not expressly granted are reserved by Top Games and its licensors.
5. Virtual items and purchases
- The App may offer virtual items such as gems that can be purchased with real money through Google Play or the Apple App Store, or earned in the App (for example, by watching rewarded ads).
- Virtual items are a limited license to use content within the App. They have no monetary value, cannot be exchanged for cash, and cannot be sold, transferred, or traded outside the App.
- All purchases are final and non-refundable except where required by law or by the refund policies of Google Play or the App Store, which handle refund requests for purchases made through them.
- We may manage, modify, or remove virtual items, including when we reasonably believe they were obtained through fraud, exploits, or violation of these Terms.
6. Advertising
The App is supported by advertising. Ads may appear between games, and you may choose to watch rewarded ads in exchange for in-game benefits. Ads are provided by third parties and we are not responsible for their content or for third-party products or services they promote.
7. Acceptable use
You agree not to:
- cheat, use bots, exploit bugs, or use unauthorized software that modifies the App or games;
- reverse engineer, decompile, or attempt to extract source code of the App, except where permitted by law;
- interfere with or disrupt the App, its servers, or other users;
- artificially generate ad impressions or clicks, or manipulate rewards or purchases;
- use the App for any unlawful purpose or in violation of these Terms.
8. Intellectual property
The App, its games, graphics, sounds, and other content are owned by Top Games or its licensors and are protected by intellectual property laws. Third-party trademarks belong to their respective owners.
9. Third-party services
The App relies on third-party services such as Google Play, the Apple App Store, Google and Apple sign-in, and advertising providers. Your use of those services is subject to their own terms. Apple and Google are not parties to these Terms and are not responsible for the App or its content.
10. Termination
You may stop using the App at any time. We may suspend or terminate your access to the App, with or without notice, if you violate these Terms or if we discontinue the App. Upon termination, your license and any unused virtual items end, except where the law requires otherwise.
11. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PROGRESS OR DATA WILL NEVER BE LOST.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOP GAMES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. Some jurisdictions do not allow these limitations, so they may not apply to you.
13. Changes
We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date. Continued use of the App after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where the mandatory consumer protection laws of your country of residence apply.
